Library of Things Borrower's Agreement and Waiver

  1. A valid Pulaski County Public Library card in good standing is required to borrow Things from the Pulaski County Public Library’s Library of Things. Patrons must be 18 years or older to borrow a Thing; a child may borrow Things if their guardian is present and has signed the Library of Things Borrower’s Agreement and Waiver.
  2. Prior to borrowing Things, all patrons must sign this Borrower’s Agreement and Waiver.
  3. By taking possession of any item, the Patron is certifying that he or she is capable of using that item in a safe and proper manner.
  4. All Things borrowed are to be returned to the library by close of business on their due date. Things not returned by their due date may be assessed a late fee equal to 10% of the total value of the Thing per day up to the total value of the item. Things may only be returned during the library’s open hours and may not be returned in the book drop. A fee may be assessed to the patron if Things are returned in the drop box.
  5. Things have a lending period of (7) days and cannot be renewed nor have their time extended.
  6. The library may replace severely delinquent (i.e. unreturned) Things, holding the patron responsible for the full replacement cost. The library reserves the right to use appropriate steps to retrieve delinquent tools or equipment or unpaid fines.
  7. Things may reserved by PCPL patrons in advance using the library’s online catalog. Patrons will be notified when reserved Things become available and have 3 business days to pick them up.
  8. Pulaski County Public Library is not responsible for any injury, loss, or damage that may occur from use of a Thing.
  9. Patron agrees that if any borrowed Thing becomes unsafe or in a state of disrepair, he or she must immediately discontinue use of the item and notify the library of the issue upon return.
  10. All Things are to be returned clean and in the same (or better) condition as they were issued, barring normal wear and tear. If an item is returned unclean, it may be charged a reasonable cleaning fee.
  11. Patron agrees to report any damage of the Thing to the library immediately. Patron agrees to pay for the loss of or damage to any item they borrow. Patron also agrees to accept the library’s appraisal of the Thing’s condition and to the library’s assessment of fair restitution for damage, dirtiness, delinquency, and/or partial or total loss of the Thing. The restitution could equal the full replacement cost of the Thing.
  12. It is the borrower’s responsibility to protect Things against loss or damage.

 

I understand that the library does not provide supervision or instruction for the use of the equipment. I understand and acknowledge that the use of the equipment may involve risk of serious injury, including permanent disability and death. I agree to refrain from using any equipment in a manner inconsistent with its intended design and purpose.

In consideration of being permitted to borrow the Thing, I hereby voluntarily waive, release, and discharge and covenant not to sue the Pulaski County Public Library, its respective successors, assigns, officers, agents, employees, and volunteers from any and all claims, actions or demands of any kind, nature and description, including claims or actions for death, personal injury, or property damage and from any and all liabilities, damage, injuries, action or causes of action either at law or in equity, whether caused by any defect in the Thing, negligent act or omission of the library or otherwise arising out of in any way related to or connected with my borrowing the Thing. The borrower also agrees to indemnify and hold the library harmless from any claims, demands, actions, and causes of action of any nature or kind which arise out of the borrower’s use of the borrowed item.

I state that I have read and fully understand that failure to comply with any of these rules may result in the revocation of my borrowing privileges.
